MODCER™, the MODCER stylized logo, and any other product names, slogans, graphics, page headers, and service scripts featured on the Site are registered or unregistered trademarks, trade names, or trade dress of [MODCER LLC] in the United States and other countries.

Our trademarks and trade dress may not be used in connection with any product or service that is not provided by us, in any manner that is likely to cause confusion among consumers, or in any manner that disparages, dilutes, or discredits the brand reputation of [MODCER LLC].

2.3 Enforcement of Intellectual Property

We actively monitor global marketplaces and digital platforms. Any unauthorized reproduction, counterfeiting, modification, distribution, scraping via automated bots, reverse engineering of our ceramic designs, or commercial exploitation of our creative assets will be met with immediate legal action, including but not limited to statutory damages, injunctive relief, and recovery of attorney’s fees.

SECTION 3 - DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) COMPLIANCE

SECTION 4 - ARTISANAL & HANDMADE CERAMIC EXEMPTION CLAUSE

The products offered on this Site are high-end, premium, individually hand-sculpted, glazed, and fired ceramic art sculptures. By purchasing from [MODCER], the customer explicitly acknowledges, understands, and accepts the following inherent characteristics of premium handmade ceramic art:

  • Natural Micro-Variations: Due to the organic nature of raw Kaolin clay and high-temperature kiln firing techniques, each sculpture is entirely unique. Minor variations in dimensional measurements (including slight deviations from standard specifications), weight, structural contour, micro-pinholes, mineral iron spots, and organic glaze flowing patterns are natural and desirable characteristics of elite craftsmanship, not manufacturing defects.

  • Color Discrepancies: While we utilize professional, un-oversaturated photography to represent our work as accurately as possible, final visual colors may vary slightly due to individual monitor calibration, ambient lighting, and individual kiln firing temperatures.

  • No Grounds for "Not as Described" Claims: These organic variances shall not constitute grounds for legal claims, automatic chargebacks, or "Item Not as Described" disputes with credit card companies or payment processors.

SECTION 5 - "AS IS" WARRANTY DISCLAIMER

SECTION 8 - SEVERABILITY & ENTIRE AGREEMENT

If any provision of this Legal Notice is deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that specific provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
